Contest Rules for Our 2011 Photo Contest

This contest is void where prohibited.

Contest participants must be 18 years or older.

The top prize is one week's accommodation in a comfortable, fully equipped one or two-bedroom vacation suite which can be selected at a great variety of destinations. Locations are available in various parts of Europe, Canada, the United States, Latin America, and Australia - you can select your one week getaway literally in one of hundreds of places around the world. This is great for a vacation with friends and family, you'll have your own fully equipped home away from home. (Transportation to and from the vacation destination and local spending not included.)

The creator of the second most popular photo will receive a $150 online gift certificate from an online retailer such as www.expedia.com, www.amazon.com or iTunes, while the third most popular photo will receive a $50 online gift certificate.

No contest entrant can win more than one prize.

The contest will be open until 11:59 pm on November 20, 2011. Winners will be notified by 11:59 pm EST on November 30, 2011. If you are a winner, you must respond within fifteen (15) days of such notification. If you don’t respond within that time, you may be disqualified and may not receive a prize and another contestant may be selected.

All submitted photos require a brief description of up to 420 characters.

You may submit up to 3 photos a day during the contest period.

Contest photo entries will be voted on by Travel and Transitions audience, and the 3 winning photos will be determined on the basis of the largest number of Likes, however, no contestant can win more than one prize.

This is a skill-based contest, and chance plays no part in the determination of winners.

No purchase is required to enter the contest.

Your submission of a photo is your acknowledgement of, and agreement to, the terms and conditions of the contest.

Contest participants agree to become part of Travel and Transitions subscriber list to receive travel advice, travel stories, future contest notifications and travel savings opportunities. We only send out information occasionally and it is possible to opt out of that subscriber database at any time. Your email address will never be shared with any outsiders and you can request to be removed from our email list at any time. We respect our readers’ privacy.

Your photo entries must have been created by you and you must not submit a photo created by someone else. You must be the sole owner of all rights to the photos you submit.

You will retain full rights to your photos, however, you will grant Travel and Transitions the right to publish any winning photos at any time in the future, without any fee or other form of compensation.

In the event that ownership of, or rights to, any photo submitted to the contest is contested in any manner, Travel and Transitions retains the sole discretion to disqualify that photo from the contest and discontinue use of the photo.

In the event of a dispute regarding who submitted a photo, you may be requested to prove that you are the authorized account holder.

The subject of the photo contest is travel. Photos must be appropriate for posting on a public website. Photos that contain obscene, provocative, defamatory, sexually explicit or otherwise objectionable or inappropriate content will not be considered. Travel and Transitions will determine, in its sole discretion, what constitutes such content.

You must obtain a consent or release from all identifiable people in your photo(s) for use of their image in your photo.

For photos that include identifiable children, your submission must be accompanied by a signed consent form from each child’s parent/legal guardian.

Travel and Transitions is not responsible for computer system, hardware, software or program malfunctions or other errors, failures, or delayed computer transactions or network connections that affect the contest or your participation in it. Furthermore, Travel and Transitions is not responsible for: 1) lost, misdirected, misplaced, illegible, unintelligible, incomplete or late entries or 2) any act, failure to act, or delay regarding the transmitting or processing of entries.

You acknowledge that Travel and Transitions reserves the right, in its sole discretion, to cancel or suspend all or any portion of this contest without notice for any reason whatsoever, without any liability to you for any costs you may have incurred in respect to the contest.

Travel and Transitions is entitled to interpret these rules as required and its decisions are final.

This contest is subject to all applicable federal, provincial and municipal laws and regulations. These contest rules are subject to change without notice in order to comply with any applicable federal, provincial and municipal laws or the policy of any other entity having jurisdiction over the contest.

Travel and Transitions reserves the right to disqualify any contestant that it has reason to believe does not comply with the contest rules. If after the awarding of the contest prizes a contest winner is disqualified or determined to be ineligible, an alternate winner will be selected using the same judging process/criteria described above. Alternate winners are subject to all requirements set forth in these rules.

By participating in the contest, you agree to hold harmless Travel and Transitions, its employees, agents and representatives from any and all damages, injuries, claims, causes of actions, or losses of any kind resulting from your participation in this contest, including infringement of another person’s intellectual property rights. You also release Travel and Transitions, its employees, agents and representatives from any responsibility or liability for any damages, injuries, claims, causes of actions, or losses of any kind you may incur or suffer arising in whole or in part from your participation in this contest.
